The End of Romance? Law Commission Marital Agreement Consultation Event Dates

Pre-nuptial and post-nuptial agreements have been very much in the news recently, with the Supreme Court decision in Radmacher v Granatino [2010] UKSC 42 and the Law Commission's new consultation paper on marital property agreements prompting debate over the extent to which the law should recognise such agreements.

In a series of consultation events, Professor Elizabeth Cooke, Law Commissioner for England and Wales, will outline the questions raised by the Law Commission. Key issues include the balance to be struck between respecting personal autonomy and protecting people from pressure, the safeguards that would be needed if these contracts were to be enforceable, and the type of property that might be "ring fenced" from the financial consequences of divorce.

These are very practical questions, but they raise profound issues about the nature of equality and about the values and responsibilities involved in marriage and civil partnership.
The Law Commission invites comment and discussion on its proposals, which will remain open for consultation until 11 April 2011.
